Terms and Conditions

Effective Date: April 2026 | Governing Law: State of Florida

By booking, purchasing, or engaging any service from Luxe House Media ("LHM," "we," "us," "our"), the client ("Client," "you") agrees to the following Terms and Conditions in full. These terms apply to all services offered by Luxe House Media, including but not limited to online course production, content creation, Luxe Beauty AI marketing systems, platform hosting, subscriptions, add-ons, collaborations, and any custom or per-project arrangements.

1. Scope of Services

All services, deliverables, timelines, and pricing are defined by the agreed proposal, invoice, service page, or written agreement. Any work requested outside of the agreed scope requires a separate written agreement and additional payment. Luxe House Media reserves the right to decline any request that falls outside the agreed scope without penalty.

2. Services Offered

Luxe House Media currently offers the following packaged services:

2a. Online Course Production

The Signature Course and Pro Build are done-for-you course production packages that include filming, editing, platform setup, and post-launch support as defined per package. All course production deliverables, timelines, and inclusions are defined at the time of booking.

2b. Luxe Content Day

A focused content production session delivering edited reels, single clips, retouched photos, and behind-the-scenes footage as defined per package. Content Days are standalone sessions and are not interchangeable with course production sessions.

2c. Luxe Beauty AI — Marketing & Automation System

Luxe Beauty AI (LBAI) is a done-for-you marketing system that includes Meta ad campaign management on Instagram and Facebook, an AI-powered messaging system connected to the client's Instagram DMs and WhatsApp, lead qualification, and routing to the client's booking system. LBAI requires a one-time setup fee and a recurring monthly subscription as defined at the time of enrollment.

Important LBAI Terms:

The client is solely responsible for their own ad spend budget. Ad spend is separate from the monthly LBAI subscription fee and is paid directly to Meta by the client.

Luxe House Media makes no guarantees regarding ad performance, lead volume, conversion rates, bookings, or revenue generated through the LBAI system.

Ad spend already deployed to Meta campaigns is non-refundable under any circumstance, including cancellation of the LBAI subscription.

The LBAI system is built within Luxe House Media's platform infrastructure. The client does not own the system build, automations, or ad account configurations. Upon cancellation, system access is terminated.

The client retains ownership of their own Meta Business Manager, ad account, and Instagram profile. Luxe House Media does not retain access to client accounts after termination.

Luxe House Media is not responsible for Meta account suspensions, policy violations, or ad rejections caused by client-submitted content, client business categories, or Meta platform decisions.

LBAI is not a social media management service. Luxe House Media does not post content, manage profiles, or handle community engagement on behalf of the client.

2d. Luxe House Courses — Platform Hosting

Clients who complete a course production package receive 30 days of free platform hosting beginning on the date of delivery. After the free period, ongoing hosting is billed on a recurring monthly basis at the current published rate. The platform includes course hosting, student access, checkout, and payment processing monitoring.

2e. Add-On Services

Add-on services including but not limited to Landing Page builds, Ad Content Shoots, AI-generated subtitle services, and any other per-project additions are governed by these same Terms and Conditions unless a separate written agreement specifies otherwise.

2f. Per-Project and Custom Services

Photography, videography, event coverage for beauty-related events, coaching and consulting for beauty content or course building, and platform migration services are available on a per-project basis at Luxe House Media's sole discretion. These services are not standard offerings and must be agreed upon in writing prior to any work commencing.

2g. Content Collaborations

Collaborations with makeup artists and hairstylists or any other beauty professionals or content creators are unpaid creative partnerships. Participation in a collaboration does not constitute employment, a paid engagement, or a contractual obligation for future paid work. All content produced during a collaboration is owned by Luxe House Media. The collaborating artist and model receive a non-exclusive license to use the delivered content on their own platforms for portfolio and promotional purposes. Content may not be sold, transferred, or represented as original production work. Luxe House Media reserves the right to use all collaboration content for marketing, portfolio, and promotional purposes without restriction or compensation. One agreed collaborative post is expected where all parties tag each other. No revenue share, residuals, or ongoing compensation is implied or guaranteed.

3. Payment Terms

All services require payment in full prior to any work commencing unless otherwise agreed in writing. Luxe House Media does not offer payment plans, deposits, or partial payments as standard. A 4.3% processing fee applies to all credit and debit card payments. ACH transfers and Zelle payments carry no processing fee. Payment in full constitutes acceptance of these Terms and Conditions. Luxe House Media reserves the right to withhold all deliverables until full payment is confirmed.

Recurring Subscription Services (LBAI and Platform Hosting):

Monthly subscriptions are billed automatically on a recurring basis using the payment method on file.

Clients must submit a written cancellation request prior to the next billing cycle to avoid being charged for the following month.

No prorated refunds are issued for partial months of service.

Luxe House Media reserves the right to adjust subscription pricing with 30 days written notice to the client.

4. Refund Policy

All payments made to Luxe House Media are non-refundable once work has commenced. Work is considered commenced immediately upon receipt of payment, as planning, scheduling, pre-production, and resource allocation begin at that time.

In limited circumstances, and at Luxe House Media's sole discretion, a partial refund of up to 50% of the total amount paid may be considered if a project is canceled by the Client prior to any production activity. The remaining balance is retained to cover calendar blocking, lost booking opportunities, pre-production planning, administrative work, and creative preparation. Refunds are not guaranteed and are assessed case by case. Luxe House Media reserves the right to deny any refund request in full.

No refunds will be issued for:

Work already completed or delivered

Missed, abandoned, or incomplete projects due to Client inaction or failure to communicate

Services rendered, partially rendered, or scheduled

Digital products, subscriptions, hosting fees, or platform access

Ad spend deployed to Meta or any other advertising platform

Setup fees for any service including Luxe Beauty AI

Travel fees once travel has been scheduled or confirmed

Any add-on service once work has begun

5. Cancellations and Rescheduling

All cancellation and rescheduling requests must be submitted in writing. Verbal requests are not accepted. Fees paid are non-refundable upon cancellation. One reschedule is permitted per project with a minimum of 7 days written notice prior to the original scheduled date. Missed sessions, late arrivals, or incomplete production days due to Client delays are not eligible for refunds, credits, or rescheduling at no charge.

For LBAI subscriptions, cancellation requests must be received in writing prior to the next billing cycle. Access to the system will remain active through the end of the current billing period and will be terminated at the start of the next cycle.

6. Travel Policy

Luxe House Media is based in Miami, Florida. Travel within Miami-Dade County and Broward County is included at no additional charge for all services. For locations beyond Miami-Dade and Broward County, the following travel fees apply:

Online Course Production: $350 travel fee

Luxe Content Day: $150 travel fee

Luxe House Media travels up to West Palm Beach, Florida. We do not travel beyond this range for any service. Out-of-state travel is not offered under any standard package. Travel fees are non-refundable once travel has been scheduled or confirmed. Travel beyond the stated range requires explicit written approval from Luxe House Media and is not guaranteed.

7. Client Responsibilities

The Client agrees to:

Provide all required materials, information, approvals, and responses in a timely manner

Ensure that any materials provided are accurate, owned by the Client, and legally usable

Arrive prepared and on time for all scheduled production sessions

Have all models, tools, products, outfits, and materials ready prior to the session

Respond to communications within reasonable timeframes to avoid project delays

For LBAI clients: maintain an active Meta Business Manager account and provide access credentials required to run campaigns

For LBAI clients: fund their ad account with sufficient budget prior to campaign launch and maintain adequate balance throughout the engagement

Delays caused by Client inaction, unpreparedness, or failure to communicate may result in timeline extensions, forfeited session time, or additional fees. Luxe House Media is not responsible for missed deliverables caused by Client delays.

8. Content Delivery and File Retention

All final deliverables including edited videos, photos, graphics, and approved content assets are delivered digitally via Google Drive, Dropbox, or a similar third-party platform selected by Luxe House Media. These platforms are used strictly for delivery purposes and are not intended for long-term storage or archival.

Download Window:

All delivered content must be downloaded within 15 business days from the date delivery is made available. After the 15-business-day window, Luxe House Media reserves the right to permanently delete all project files including final edited videos, final images and photos, exported content assets, and all project and working files. Once deleted, files cannot be recovered. Luxe House Media is not liable for any data loss after the delivery window has passed.

Re-Delivery:

If files are still available after the delivery window, re-delivery is not guaranteed and may be subject to a file recovery and re-delivery fee based on availability.

9. Raw Footage Policy

Luxe House Media does not provide raw footage, unedited files, or original project files as a standard deliverable. Any exception must be explicitly agreed upon in writing prior to production as a separate paid deliverable. This applies to all services including course production, content days, and ad content shoots.

10. Revisions and Approval

Revision limits are defined by the selected service or package. Additional revisions beyond what is included are subject to additional fees at the published rate. The Client must review all deliverables and submit revision requests within 5 business days of delivery. Failure to respond within this timeframe constitutes acceptance of the delivered content in its current form. Revisions do not apply to AI-generated deliverables such as subtitles, which are provided as-is.

11. Intellectual Property and Usage Rights

Luxe House Media retains full ownership of all original project files, raw footage, working materials, system builds, automation configurations, and creative infrastructure. Upon full payment, the Client is granted a non-exclusive, perpetual, worldwide license to use the final delivered content for their own business, marketing, advertising, and promotional purposes. This license is limited to the client's own use and does not transfer ownership.

Content may not be resold, transferred, sublicensed, or claimed as original production work by the Client

Luxe House Media reserves the right to use any completed work for portfolio, marketing, and promotional purposes unless otherwise agreed in writing prior to the project

LBAI system builds, automation flows, ad structures, and AI messaging configurations remain the intellectual property of Luxe House Media and are not transferable to the Client upon cancellation

12. Platform — Luxe House Courses

Clients who host their course on the Luxe House Courses platform are subject to the following:

The Client receives 30 days of free platform hosting beginning on the delivery date. Billing begins automatically at the start of the 31st day.

Clients are granted administrative access to their course environment. Once access is granted, the Client assumes full responsibility for any changes, edits, or modifications made directly by the Client or any third party acting on their behalf.

Luxe House Media is not responsible for platform issues, broken automations, payment failures, or functionality loss caused by Client-made changes or third-party integrations.

Standard platform hosting covers uptime monitoring, core system operation, website and checkout accessibility, and payment processing availability. It does not include training, content edits, design changes, or automation restructuring.

Additional support requests outside of standard maintenance are billable. A one-time courtesy fix may be extended at Luxe House Media's discretion. Subsequent incidents are billed at $250 for minor issues and up to $500 for major system restoration.

Upon cancellation of hosting, access may be suspended or terminated and data may be deleted after 30 days. Luxe House Media is not responsible for data loss following account termination.

Luxe House Media only builds and supports courses on the Luxe House Courses platform. We do not build on or support Kajabi, Teachable, Thinkific, Podia, Mighty Networks, or any other third-party platform. If a client requires their course on a third-party platform, Luxe House Media may assist with uploading and organizing content as a per-project arrangement, but no ongoing support, maintenance, or management is provided after delivery.

13. Luxe Beauty AI — Subscription Terms

Enrollment in Luxe Beauty AI constitutes agreement to the following specific terms in addition to the general Terms and Conditions:

The LBAI monthly subscription fee covers system management, Meta ad campaign oversight, AI messaging system maintenance, and ongoing platform access. It does not include ad spend, which is the sole responsibility of the Client.

The one-time setup fee covers system build, account connections, AI messaging configuration, ad account setup, and client onboarding. The setup fee is non-refundable under all circumstances.

Luxe House Media manages campaigns within the client's Meta Business Manager using access granted by the client. The client retains ownership of their ad account and Meta Business Manager at all times.

Luxe House Media is not responsible for Meta platform policy changes, account restrictions, ad disapprovals, or account suspensions. These are governed entirely by Meta's policies.

The Client acknowledges that ad performance varies based on audience, budget, creative quality, offer, and market conditions. Luxe House Media makes no guarantees of results, leads, bookings, or return on ad spend.

The Client is responsible for ensuring their content, offers, and business practices comply with Meta's advertising policies. Luxe House Media is not liable for ad rejections or account actions caused by non-compliant client content.

Upon cancellation, the LBAI system access will be terminated at the end of the current billing cycle. Ad campaigns will be paused and access to the AI messaging system will be removed. Clients retain access to their own Meta Business Manager and ad accounts.

Luxe House Media reserves the right to terminate LBAI service immediately without refund if the client is found to be in violation of Meta's advertising policies, engaged in fraudulent activity, or in breach of these Terms and Conditions.

14. Third-Party Content and Permissions

The Client warrants that they own or have legal rights to all third-party content provided to Luxe House Media, including music, logos, fonts, images, likenesses, trademarks, and any materials used in ad campaigns or course content. Luxe House Media is not responsible for any copyright or licensing violations related to Client-provided materials. The Client agrees to indemnify Luxe House Media against any claims arising from the use of Client-provided content.

15. Bundles and Package Combinations

The Luxe Launch Bundle (Signature Course plus Luxe Content Day) and any other bundled arrangements are sold as a single package. Bundles cannot be partially refunded, split, or have individual components canceled while retaining the bundled pricing. If a bundle is canceled before production begins and a refund is assessed at Luxe House Media's discretion, the refund amount is calculated on the total bundle price paid, not on individual service values.

16. AI-Assisted Deliverables

Certain deliverables, including but not limited to AI-generated subtitles and captions, are produced using artificial intelligence tools. These deliverables are provided as-is. Luxe House Media does not guarantee the accuracy, completeness, or error-free nature of AI-generated content. The Client is responsible for reviewing and correcting any AI-generated deliverables before use. AI-assisted deliverables are not eligible for revision requests under the standard revision policy.

17. No Guarantees or Warranties

All services and deliverables are provided as-is. Luxe House Media makes no guarantees regarding sales, revenue, profit, engagement, views, reach, conversions, bookings, course enrollment, platform performance, algorithm behavior, or any outcome related to the use of delivered content or systems. Results depend on many factors outside of Luxe House Media's control including but not limited to the Client's market, offer quality, audience, pricing, business operations, and platform algorithms.

18. Limitation of Liability

Luxe House Media's total liability for any claim arising from any service shall not exceed the total amount paid by the Client for the specific service giving rise to the claim. Under no circumstances shall Luxe House Media be liable for indirect, incidental, consequential, punitive, or special damages including but not limited to lost revenue, lost profits, lost business opportunities, or damages arising from the use or inability to use delivered content or systems.

19. Indemnification

The Client agrees to defend, indemnify, and hold harmless Luxe House Media, its owner, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses including reasonable legal fees arising from or related to:

Client-provided materials or content

Misuse or unauthorized use of delivered content

Violation of any third-party intellectual property or licensing rights

Client's business operations, offers, or advertising content

Client's violation of Meta's advertising policies or platform terms

Any action or omission by the Client that results in a claim against Luxe House Media

20. Force Majeure

Luxe House Media is not liable for delays or failures in performance caused by events beyond reasonable control, including but not limited to acts of God, illness, equipment failure, platform outages, power failures, natural disasters, pandemics, or government actions. In such circumstances, Luxe House Media will make reasonable efforts to reschedule or continue services as soon as practicable.

21. Confidentiality

Luxe House Media agrees to treat all Client business information, course content, strategies, and proprietary materials shared during the course of any project as confidential and will not disclose such information to third parties without the Client's consent, except as required by law. The Client agrees to keep any proprietary systems, processes, or methodologies shared by Luxe House Media confidential and will not replicate, share, or reverse-engineer such systems.

22. Governing Law and Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these Terms and Conditions or any service provided by Luxe House Media shall first be attempted to be resolved through good faith negotiation between the parties. If negotiation fails, disputes shall be subject to binding arbitration in Miami-Dade County, Florida, in accordance with applicable arbitration rules. The prevailing party shall be entitled to recover reasonable legal fees and costs.

23. Modifications to Terms

Luxe House Media reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted publicly at the current terms and conditions URL. Continued use of any Luxe House Media service after updated terms are posted constitutes acceptance of the revised terms.

24. Entire Agreement

These Terms and Conditions, together with any written proposal, invoice, or service agreement, constitute the entire agreement between Luxe House Media and the Client with respect to the services engaged. These Terms and Conditions supersede all prior discussions, representations, warranties, or agreements, whether oral or written. No modification to these Terms and Conditions is valid unless made in writing and signed by an authorized representative of Luxe House Media.

25. Acceptance of Terms

Booking, purchasing, subscribing to, or engaging any service from Luxe House Media constitutes full and unconditional acceptance of these Terms and Conditions. The Client acknowledges that they have read, understood, and agreed to be bound by all provisions contained herein.
